Abstract

This speech is a brief discussion of flat-rate compensation. It has been decided that such claims are permissible under Art. 361 § 2 of the Polish Civil Code. However, they cannot change the substance of the damage claim. Therefore, such a claim cannot be divorced from the circumstances, in which the injury was sustained, nor be disproportionately large compared to the extent of the damage.
